When you contact Kitchenet through the Kitchenet Websites for the purpose of requesting, receiving, or purchasing products or services, Kitchenet may collect, process, and store certain personal information about you. The collection, use, disclosure, and retention of such personal information is governed by the provisions of the Kitchenet Online Privacy Policy, which forms an integral part of these Terms, and in compliance with the Data Protection Act, 2012 (Act 843) of Ghana, as well as any applicable laws in Nigeria, the United Kingdom, or other relevant jurisdictions.
By using the Kitchenet Websites, you agree to provide true, accurate, current, and complete information whenever such information is requested by Kitchenet. Access to and use of the Kitchenet Websites granted under any separately executed agreement between you and Kitchenet shall supersede the terms set forth in this section, and in the event of any inconsistency, the provisions of the separately executed agreement shall prevail.
You expressly acknowledge and agree that Kitchenet reserves the right, at its sole discretion and without prior notice, to terminate, suspend, or restrict your access to all or any portion of the Kitchenet Websites, or to remove, delete, or discard any User Content that you may have submitted. Such termination or suspension may occur at any time and for any reason, including but not limited to actual or suspected violations of these Terms, unlawful conduct, or technical or security concerns.
You further acknowledge and agree that Kitchenet may take any action it deems necessary or appropriate, whether legal, technical, or otherwise, to prevent, block, or deny your ability to access, register for, or continue participation in the Kitchenet Websites. The exercise of such rights is at the exclusive discretion of Kitchenet, and you hereby waive any claim arising out of or relating to such termination, suspension, or denial of access.

You retain the right to discontinue your participation in, and access to, the Kitchenet Websites at any time. However, in the event you breach any of these Terms, your authorization to use the Kitchenet Websites shall automatically terminate without notice, and you must immediately cease all use of the Websites and destroy any and all downloaded, stored, or printed Materials (including any copies thereof).
The Kitchenet Websites are provided strictly “as is” and “with all faults”, without any representations, warranties, or conditions of any kind, and confer no rights of any nature. You acknowledge and agree that the entire risk as to the quality, availability, security, and performance of the Kitchenet Websites lies solely with you. To the fullest extent permitted by applicable law, Kitchenet, together with its officers, directors, employees, and agents, expressly disclaims all warranties—whether express, implied, or statutory—in connection with the Websites and your use thereof.
Kitchenet makes no warranty or representation concerning the accuracy, reliability, or completeness of the content on the Websites, nor the content of any third-party sites linked to or from the Websites. Without limitation, Kitchenet assumes no responsibility or liability for:
(i) any errors, mistakes, or inaccuracies in content;
(ii) personal injury, death, or property damage of any kind resulting from your access to or use of the Websites;
(iii) any unauthorized access to or use of our secure servers and/or any and all personal or financial information stored therein;
(iv) any interruption, delay, suspension, or cessation of transmission to or from the Websites;
(v) any viruses, worms, trojans, malicious code, or other harmful components transmitted to or through the Websites by third parties; or
(vi) any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of content transmitted, posted, emailed, or otherwise made available through the Websites.
Kitchenet does not warrant, endorse, guarantee, or assume responsibility for any product, service, or offering advertised or provided by a third party through the Websites, any hyperlinked site, or any banner, widget, or other advertising feature. Kitchenet shall not be a party to, nor shall it be responsible in any way for monitoring, any transaction entered into between you and third-party providers of products or services.
Kitchenet expressly disclaims any and all warranties of any nature, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, quiet enjoyment, title, and non-infringement of intellectual property rights. Without limiting the generality of the foregoing, Kitchenet makes no warranty that the Websites will:
meet your requirements,
operate without interruption, delay, error, or security breach,
be free from defects or that defects will be corrected, or
provide accurate, reliable, or verifiable results.
No advice, guidance, or information, whether oral or written, obtained by you from Kitchenet, its affiliates, subsidiaries, parents, suppliers, licensors, or their respective officers, employees, or agents (collectively, the “Kitchenet Parties”) shall create any warranty, representation, or guarantee not expressly stated herein.
Kitchenet further disclaims any and all equitable indemnities.
To the maximum extent permitted by applicable law, in no event shall Kitchenet, its parent, subsidiaries, affiliates, officers, directors, employees, agents, licensors, or representatives be liable to you or to any third party for any indirect, incidental, special, punitive, exemplary, or consequential damages of any kind. This includes, without limitation, damages for:
(i) errors, inaccuracies, or mistakes in content;
(ii) personal injury, death, or property damage of any nature whatsoever arising from your access to or use of the Websites;
(iii) any unauthorized access to or use of our secure servers and/or any and all personal, financial, or confidential information stored therein;
(iv) any interruption, suspension, delay, or cessation of transmission to or from the Websites;
(v) any viruses, trojans, worms, malicious code, or other harmful programs that may be transmitted to, through, or from the Websites by a third party; and/or
(vi) any errors, omissions, or defects in any content, or any loss or damage of any kind incurred as a result of the use of any content transmitted, posted, emailed, or otherwise made available through the Websites.
Without limiting the foregoing, Kitchenet shall not be liable for any damages or losses of any nature whatsoever, whether direct or indirect, arising out of or related to:
lost revenues, lost profits, loss of goodwill,
loss of anticipated savings, loss of data, loss of use,
business interruption, or other intangible or economic losses,
arising out of or connected with your access to, use of, inability to use, or the results of the use of the Kitchenet Websites, or reliance on any content provided therein.
Such exclusions apply whether the claim is based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, and regardless of whether Kitchenet has been advised of, knew of, or should have foreseen the possibility of such damages.
Certain jurisdictions do not permit the exclusion of specific warranties or the limitation or exclusion of liability for particular damages. As a result, some of the disclaimers and limitations of liability set forth above may not be applicable to you. To the extent that any Kitchenet Party is, under applicable law, unable to disclaim any implied warranty or restrict its liabilities, the scope and duration of such warranty, together with the extent of the Kitchenet Party’s liability, shall be construed and enforced to the minimum degree allowed under the relevant applicable law.
Certain laws in Ghana do not allow the exclusion of specific warranties or the limitation of liability for certain types of damages. Accordingly, some of the disclaimers and limitations of liability described herein may not apply to you. To the extent that Kitchenet, under the laws of Ghana, is not permitted to disclaim an implied warranty or restrict its liability, the scope and duration of such warranty, and the extent of Kitchenet’s liability, shall be applied only to the minimum level permitted under Ghanaian law.
In compliance with Ghanaian consumer protection standards and advertising regulations, Kitchenet makes the following disclosures regarding material connections:

Kitchenet retains the right to delete User Content without advance notice. By submitting User Content on the Website you agree to indemnify Kitchenet against and from all liabilities, verdicts, losses, and expenses (including attorney’s fees) sustained by Kitchenet resulting from or connected to your User Content.
